Terms of Service

1. Eligibility and Account Registration

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for accurate account information and safeguarding credentials, including OAuth logins.
• Notify us promptly if you suspect unauthorized access to your account.

2. Workspace Management and Projects

• The Service allows you to create, duplicate, and manage projects with screenshots, metadata, and generated assets.
• You are responsible for ensuring uploaded assets comply with laws, platform policies, and third-party rights.
• We may set limits on project counts, storage quotas, or generation credits and enforce them at our discretion.

3. Generative AI Output and Credits

• We use third-party models, including Google Gemini, to generate content.
• AI output may contain errors or unsuitable material; review and edit before use.
• Generation credits, tiers, or usage-based billing may apply. Credits are non-transferable and may expire.

4. User Content and License Grants

"User Content" includes screenshots, assets, metadata, prompts, and other materials you submit. You retain ownership of User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display it solely to operate, improve, and provide Service features you initiate, including autosave, exports, and landing-page builds. You represent you have the necessary rights to upload User Content and grant this license.

5. Acceptable Use

• Do not upload malicious code, disrupt the Service, or reverse engineer our systems.
• Do not use the Service to create unlawful, infringing, or harmful content or to mislead users.
• Do not access the Service via unauthorized automated means.
• We may suspend or terminate accounts that violate these Terms or introduce security or operational risks.

6. Plans, Payments, and Refunds

• Paid plans or add-ons include pricing and billing terms shown at checkout or in your dashboard.
• Plans may include limits on AI generations, storage, or exports. Exceeding limits may result in overages or throttling.
• Unless otherwise stated, fees are non-refundable once the subscription period begins, except where required by law.

7. Third-Party Services and Integrations

The Service relies on Supabase, Google OAuth, GitHub OAuth, Google Gemini, Vercel, and other infrastructure providers. Your use of their services through Lemmi Studio is subject to their terms. We do not guarantee their availability or performance.

8. Data Handling and Security

We store project data, generated assets, and logs using Supabase databases, storage buckets, and temporary processing pipelines such as Node Canvas, Sharp, and zip exports. We implement measures to protect your data, but no system is completely secure; you use the Service at your own risk. See our Privacy Policy for more details.

9. Intellectual Property

All intellectual property rights in the Service (excluding User Content) belong to us or our licensors, including software, branding, themes, font collections, templates, and documentation. You may not copy, modify, sell, or distribute any part of the Service without prior written consent.

10. Availability and Modifications

We may modify or discontinue features, impose limits, or terminate the Service at any time, provided such changes do not materially breach existing paid commitments. We are not liable for downtime caused by maintenance, outages, third-party failures, or events outside our control.

11. Feedback

If you provide feedback or suggestions, you grant us a perpetual, worldwide, irrevocable, royalty-free license to use that feedback without obligation to you.

12. Disclaimers

THE SERVICE AND ALL AI-GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ARE RESPONSIBLE FOR VALIDATING GENERATED CONTENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE PRECEDING SIX MONTHS OR (B) ONE HUNDRED US DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, losses, and expenses arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

15. Governing Law and Venue

These Terms are governed by the laws of the jurisdiction where the Lemmi Studio operator is established, without regard to conflict-of-law principles. Disputes will be resolved in courts located in that jurisdiction unless applicable law requires a different venue.

16. Changes to These Terms

We may update these Terms from time to time and will revise the effective date when we do. Continued use after changes take effect constitutes acceptance. If you do not agree with the changes, stop using the Service.

17. Termination

You may terminate your account at any time through the Service. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we stop providing the Service. Sections 4, 6, 8–15, and 17 survive termination.
